The full court is made up of 7 Democratic appointees / 4 Republican appointees with the chief being a Clinton appointee.
Meanwhile, The 4th Circuit just handed down itâs decision in a similar case challenging Obamacare subsidies in the federal exchanges. It reached the opposite conclusion and upheld the subsidies.
Why isnât THAT a Huge Court Decision???
Itâs likely that SCOTUS will have the final say on this, and I donât know how thatâll pan out.
For now, it will more important to watch Congress. As I understand it, this could be a quick legislative fix, if it were not for intransigence in the House. If the House refuses to act (Or attaches unpalatable strings), The Dems can pummel them with it in November. Itâs almost August nowâŚThe election is pretty close, and this will generate a lot of press exactly where the Dems want it - In the red states that refused to establish their own exchanges.
Every circuit has a shot at this before it gets to the Supreme Court. So far the 9th and 4th Circuits have ruled to contrary.
