Two comments:

Trump obviously has the authority to do this, as the Congress stupidly gave it to the President in one of it’s many surrenders of power in recent history.

Probably only the four states on the actual border (TX, NM, AZ, and CA) actually have standing in this suit over the issue of eminent domain, because there will have to be condemnation of land owned by their citizens by the Federal government.
If Congress is unhappy, they can amend the law, but they will need veto proof majorities. Sad.
I disagree with both points. But the third point is I do not think Trump expects or even cares if he wins.
The second point first, because money will be taken from projects in states not on the border, all states have standing.
The first point is Trump does not obviously have authority. A “national emergency” is not whatever the President says it is. As it allows for moving money around without getting permission from Congress, this is different from most other “emergencies” and I think Trump will lose.
But again, Trump wants the issue and does not care if he loses to “the Deep State” so long as it keeps his base aroused.
I was up at dawn writing an angry email to Senator Warren asking her WHY exactly Massachusetts not only wasn’t spearheading this with California, we aren’t even on the list …
She needs to get off the GD campaign trail and get to work!!

Congress never gave the president the authority to take money from someplace Congress allocated it to and use it elsewhere without permission. That is a clear violation of the Separation of Powers.
Unfortunately, some states’ Attorneys General are Republican.
And some, like my own (Massachusetts’) are not on board yet.
I think you’re right, and losing to the “Deep State” gives him both cover and a point around which his base will rally.
