The conservative contingent of the Supreme Court questioned agencies’ ability to mandate the COVID-19 vaccine Friday, often asking why that power shouldn’t be left to Congress instead.
Decisions handed down by the Reactionary Five (and often Six) are piling up a powerful case for expanding the Supreme Court–if, that is, the nation survives the depredations of “conservative” judges, legislators, and presidents long enough to have a viable future.
If the Democrats can hang onto the House and Senate in '22, a thorough overhaul of the Court must be on the agenda.
I am not amused. “Existing policies and procedures based on historical precedent? What are they even? The National Committee for Emergency Response will almost certainly take up the matter of your currently burning house at its next quarterly board meeting three months from this date.”. ffs.
Here it comes. I was wondering when these clown would go full on wingnut…my wait is over. Forget anything good for USA coming out of that foul SCOTUS…it’s all about GOP there. It will be fun to watch these horrible people walk all this feigned “anti executive” crap back when a GOP’er is in office.
How much longer are we gonna keep pretending that our 1787 constitution is still adequate? Are progressives ready for what comes next? I guarantee you that the GQP and its enablers are, and their vision is A LOT closer to the Handmaid’s Tale than it is, say, the Basic Law of Germany
So what would be the purpose of an executive branch of government then? No need for political appointees, and then no jobs to handout to big backers either.
So if Hobby Lobby does one thing and Michael’s another and it becomes a lawsuit the Supreme Court has to decide, after months going thru the lower courts. Sounds like we’ll need more Justices to actively legislate from the benches.
I’d pick Hillary and Obama first for expansion, then people like Katie Porter or Michael Brune or some smart liberal actor or someone like E.O.Wilson.
"Why doesn’t Congress have a say in this, why isn’t it the primary responsibility of the states?” Chief Justice John Roberts asked, accusing the administration of using disparate agency mandates as a “workaround” to replace congressional action.
Ok, then, when Russia or China invades the US, the POTUS will order the military to defend all States, except whatever State you’re in. You’re on your own because States’ Responsibility. Good luck!
He’s actually making the right argument here. Congress could make this whole thing moot by passing one single goddamned law explicitly authorizing DOL and HHS to mandate vaccines.
