A lot of things happened. Here are some of the things. This is TPM’s Morning Memo.
The Supreme Court announced on Sunday that Justice Clarence Thomas was admitted to Sibley Memorial Hospital in D.C. over “flu-like symptoms” on Friday, and has been diagnosed with an infection.
While I must, in my most unctuous tones wish Justice Thomas good health, I hope that for once in his life he will do the right thing: resign his seat and turn state’s evidence about his wife’s role in trying to subvert the election. 1/6! 1/6! 1/6!
We may be at an inflection point on The Ukraine. If the Russians decide to reduce Mariupol to rubble, are the U.S. and NATO just going to sit back and watch? I am not necessarily arguing for intervention, but it will be hard to stay out…
The justice will miss some oral arguments because he won’t be participating in them remotely, the Supreme Court said. He’ll consider and discuss the cases based on briefs, transcripts and audio of the hearings instead.
PFFT… Thomas doesn’t even need to consider or discuss anything… we already know how he will rule on just about anything.
Fortunately, Thomas has been able to file his vote on all of the issues on the docket ahead of time without needing to hear argument, and will have the Federalist Society fill in the necessary legal word salad opinion later.
So why is this such a big potential problem? For starters, the person Beals used to work for – State Senator Amanda Chase ® – is a huge proponent of so-called “election integrity,” of voter suppression, and of the “Big Lie” about the 2020 presidential election. Chase is also an extremist in just about every way, was at the January 6, 2021 insurrection rally, etc
We’ve already gotten a pretty good idea of how Republican senators plan to oppose Jackson’s appointment, even though it’s all but guaranteed that she’ll be confirmed:
Critical race theory (which definitely has nothing to do with the fact that she’s a Black woman, of course)
Is she really qualified for the job? Are we sure her being a Black woman isn’t the only reason she was nominated?
On the first point, she should have her full dossier of appropriate cases in front of her to be able to clarify her positions on these cases - not that it’ll matter to her accusers, but it will put the truth in front of those that actually care.
On the second point, I said it yesterday - she should quote the young black man who said he lives with race issues every day and not only agree with him, but demonstrate how such a question would not have been asked of Amy Comey Barrett or Kavanaugh.
On the final point - here are my LSAT scores. Where are yours? Here’s my GPA from my higher education. Where are yours? Or, not wanting to do that, where in the qualifications for this job do LSAT scores fall?
She’s had ample time to come up with appropriate and stinging responses to this nonsense. She needs to do that. Sadly, of course, she will then be accused of not having the appropriate temperament because they will then frame her as an angry black woman.
She might also contest, where were all these questions when you confirmed me for the last judicial position less than a year ago?
