A federal appeals court on Tuesday upheld a lower court’s ruling that the House of Representatives can see materials from the grand jury former special counsel Robert Mueller empaneled to investigate Russian election meddling.

Next Stop: The Supreme Court, where it will be blocked because the entire Congress didn’t vote to sue…or some other “reason.”

I am waiting for William Bar to respond with ‘yes, you may see them, but the Appeals Court said nothing about touching, possessing or reading them so the House of Representatives will have to be content with viewing from a safe 10-15 foot distance’. In any case off the Supremes we go!! Yet another calculated delay.

I speculated that after Biden’s Super Tuesday win the courts would double back and rule against Trump on a number of these legal matters relating to #trumprussia and impeachment to prepare for the next Democratic Administration. They only like ‘unitary executive’ views when they favor GOP Presidents, not Democratic Presidents.

I listened to the oral argument on this case and was astounded at how nutty Neomi Rao was. She literally suggested that DOJ could refuse to abide by a court ruling and that there might not be a remedy in such an event, so the court might not be willing to step in and provide one (since Barr will ignore it anyway). Truly astounding. That is, btw, the strategy Barr may pursue.

Dems won this won 2-1 with Rao dissenting. I’ll bet DOJ goes directly to SCOTUS because the full appeals court will uphold the decision. I think SCOTUS will uphold the appeal.

I think they’ll ask for the full appeals court so they can further delay. It’s all about delay for these a$$holes.

+1. Rao is a true trumpian. No integrety at all, just watch her flip and vote against everything Biden does as president.

The big tell here is that Judge Griffith’s (appointed by Bust II) rejected the “we can’t wade into this, its a political question” argument. Remember Griffith is a mormon extremely conservative “torture memo” judge who went with Judge Henderson in the McGhan case saying executive officials were immune from having subpeonas enforced.

So Barr just announces the grand jury transcripts and related docs are in Trump’s personal possession. Even if SCOTUS upholds Trump just refuses to release them. What are the courts going to do, cite Trump with contempt? Ha, Ha, ha, that’s a good one! Trump is not subject to any laws, simply by virtue of the fact he can’t be charged, arrested, or indicted (see OLC directive). If Trump says the House doesn’t get them, they don’t get them.

“I have them in a safe in the Lincoln Bedroom, and that’s where they’re staying.”

What’s anyone going to do about it, storm the White House and crack the safe?

Don’t worry…the people hired to create a dictatorial authoritarian POTUS so that the plutocracy can own the WH will be sure to protect Trump fro the grand jury materials being provided…

They’re already busy trying to upend long standing law regarding the limits of POTUS power to interfere with the structure and function of agencies that are purely statutory in their creation and nature…

ETA: And the sheep over there are so fucking programmed that they think this is about making CFPB accountable? Limiting the firing of the head of CFPB to “for cause” isn’t accountable? Despite “for cause” by definition meaning he’s being held accountable? They can’t see that this is about the plutocracy wanting to buy the POTUS’s appointment so that a toady lickspittle is placed in charge of CFPB who will go soft on consumer abuses. THAT is where accountability fails: at the instant the dollar changes hands.

Rao is such a hack, I won’t dignify her by using the preface Judge.

Every time the House brings a legitimate investigatory case to the courts, she dissents on the basis that the House has impeachment as a way of keeping the President in line. Now that they’re asking for information based on impeachment, she still dissents. This is hackery at its worst.
