If the case against Flynn is dropped, does that nullify the plea deal, so they could go after him and his son for the other crimes in the deal? Of course Bill Barr’s “Justice” department wouldn’t do that, but could someone in the future?

Does a POTUS’s authority to grant pardons for Federal crimes extend to include perjury in Federal court?

The way I see it; Flynn is fucked.

  1. If he told the TRUTH when he plead guilty to lying to the FBI, his conviction stands as submitted.
  2. If he was LYING when he plead guilty to lying to the FBI, he committed PERJURY before the court and can be convicted by the Judge without any DOJ input required.

It’s also Judge Sullivan allowing Barr and his compliant DoJ buddies to twist in the wind for the rest of the summer, and done with all due judicial courtesy.

Barr and Trump will regret crossing Sullivan.

And Truth Over Facts? Isn’t that a strange phrasing? Was it written by Russians? Wouldn’t Truth about Facts or regarding facts sound better? Though, to be really truthful, it should really be Lies and the Lying Liars who Tell Them. Just cut Al Franken in on the “royalties”.

He has perjured himself regarding his previous perjury.

White guys with influence and contacts get to cry foul and claim they were unfairly trapped into lying. The cure is always to simply tell the truth, but that is never seen as one of the choices available. After all, telling the truth may actually expose crimes other than perjury. Barr’s interference in this straightforward case is one of the most dangerous things he has done, but all he is doing is beating his personal “best” every week. I suppose this will seem minor when he starts indicting and/or arresting members of the Obama administration right before the election.

Assuming that Judge Sullivan doesn’t just deny the motion to dismiss and proceed to sentencing (which I think he can do, albeit pretty much unprecedented), it depends.

The judge has the option to dismiss either with prejudice to refiling or without prejudice to refiling. If it’s without prejudice, the next administration’s DOJ could refile charges, including all the potential charges that were dropped as a result of the plea deal. The statute of limitations for most federal criminal charges is five years, so that would not be a bar to refiling.

Of course, it’s all academic since Trump is going to pardon Flynn, Manafort, Stone, and dog only knows how many others as soon as the election is over.

The Trump administration has so far successfully prevented Congress from investigating their criminality. We’ll soon see if they are able to prevent the Courts from such an investigation.
