This rather critical piece of context is completely absent from the morning’s writeups in NYT and other major outlets. Unsurprising but dismaying nonetheless, and setting up many casual observers for the inevitable smackdown from en banc followed by cries of “unfair!” and calls for remanding the independent judiciary even further - thus providing ammunition for the inevitable haughty response from SCOTUS…

Violence is never the answer. The reason violence is never the answer is because we live in a society of law and order where even should we be arrested on false charges we would be entitled to due process, to have our case heard fairly before a court of law where we all have equal standing. If the authorities were to arrest you, comply and cooperate. You will get your chance to be heard. Your safety is assured. There is no reason to fight back or endanger or harm those who are enforcing the law.

Now if we lived in a world where masked men who are unidentifiable could grab you off the street and make you disappear to some torture camp with no chance to have a hearing in court, if there was a significant possibility that being seized by authorities would mean you would never see your loved ones again and would face torture and possibly death rotting in a prison cell somewhere without trial. Now that would be a time for violence. Fight for your own life using whatever force is needed to preserve it for if you are taken there is no recourse. Fortunately, we all know what world we live in.

Concerning fear, anger, and fighting. Fear is good energy for avoiding an attack; but only backed by serious training and leadership. Anger is good energy for fighting; again, only with serious training and leadership. Fear and anger effectively shut down the forebrain that thinks, leaving the unthinking hind brain (amygdala system) in charge. An untrained fighter soley dependent on fear/anger/hind brain will thrash around, possibly injure or kill someone including him or her self. The training one has undergone, or not, will take over when fear/anger/hind brain engage. Effective training will allow a fighter to avoid, neutralize, unbalance, and counterattack an opponent. I submit the foregoing as one who was trained, who fought, and trained others for decades. I’m watching for leadership, for realistic, effective ways to fight back. I’m not interested in angrily or fearfully thrashing around. That is simply guaranteed ineffectiveness. I’m curious about the military; it has been very quiet, somewhat passive/aggressive in its responses to being used for show by the current administration.

“Hacks” is too kind to them, by far. And now we’re getting Bove, confirmed by a supine Republican Senate majority, and who is even worse than Rao, on the 3rd Circuit, set on a coasting trajectory toward a Supreme Court nomination.

And saying that someone is “worse than Rao” is saying a lot.

But violence, or the threat of same, is what the Right will do to continue to get what they want. They’ve taken the three branches of government and massed them into one organ that implements whatever the First Felon is after. They’re arresting citizens and non-citizens alike in the streets with no due process and sending them to countries that the victims have no connection to. Don’t like that? Fine, we’ll send you to Alligator Alcatraz until we get around to finding a place you do like (or not at all). The courts are complicit in this. They have been corrupted to the point that they no longer observe settled law.

I’m not sure waiting until midterms to do something about this is such a great idea anymore, but then again, I don’t know what other choices we have. And that’s if the midterms actually come off.

I am not a lawyer. What does “en banc” mean in normal English terms?

It’s the term for when an appeals court reconsiders a case with all* the active judges participating instead of just a panel of three. And in the D.C. Circuit, that means the trumpist hacks are outnumbered.

*Except the 9th Circuit, where they do some kind of random assignment because there are too many damn judges on that circuit.
