IANAL. Can someone explain why they couldn’t suspend implementation of sentence, instead of suspending sentencing, until the end of T34xFG’s term of office, hopefully only a year or so from now?

I remembered incorrectly then: I thought perhaps the EC could pick someone other than Vance before Dec. 6th, and that Harris, as 2nd-most-vote-getter would be a viable choice in that case. And if Vance were promoted after Dec. 6th she would be the next in line.

It’s well known that Trump pursued the office primarily to avoid prosecution. Why should these judges award him for his efforts? Such terrible jurisprudence.

He orders Kristi Noem to deport Judge Merchan.
Judge Merchan now faces two unresolved requests from Trump to dismiss the case: one that Trump filed before the election, asserting that the Supreme Court’s July immunity ruling obviates the jury’s verdict, and a second request from Trump saying that his victory in the November election should force dismissal of the case.

An American President can order an American Secretary of Homeland Security to deport anyone. What happens from there is unknown.

I also am not a lawyer, but can somebody explain to me why everybody seems to just nod at the idea that we’d have to suspend his sentence until after his term is up? I mean, his trial and conviction were before the election, he’s guilty, and there is a clear successor ready to step in until he’s out of the slammer. Let’s agree to sentence him, and if it’s jail time, lock him up for the specified period of time.

Everybody assumes, likely correctly, that the SC will step in if NY puts Trump in prison. There’s nothing in the Constitution that says a criminal can’t serve as president, and I think everyone would agree that the president can’t do their job from prison, even a nice cushy one. The people have spoken and Trump is president, as awful as that will be, so that overwhelms a state conviction. Again, it all sucks, but the SC will back him up and not let him be tossed in jail…a sentence to be served after he leaves office is the best we can hope for, but I suspect he’ll go free and the conviction will be overturned in some way.
I do hope Merchan sentences him though, and then lets the system overturn it, just to show how corrupt the entire process is. Let the Roberts court own giving Trump a free pass, it will be another mark against it.
