Biden Could Announce Supreme Court Pick This Week

Your briefing on developments in the Supreme Court confirmation battle.

As February wanes, we’re nearing the end of President Joe Biden’s self-imposed timeline to announce his Supreme Court nominee.

This is a companion discussion topic for the original entry at https://talkingpointsmemo.com/?p=1405879

Speaking in Kentucky, McConnell said he had no problem with Biden’s pledge to nominate a Black woman.

“…see, it doesn’t matter who he nominates. He could nominate jesus christ, and I’m a’gin it.”

  • Senate Democrats would have to change chamber rules to bypass the lack of committee quorum.

Shouldn’t be necessary, and probably won’t be, but if push comes to shove Manchin/Sinema had better be cool with it.

I’m encouraged by mitch’s comment. Maybe he’s being reasonable just to piss off tfg. Hopefully he’s aware of things being about to head south bigly for demented donnie. (fingers crossed).

Whoever it is, McConnell has his 6-3 Thomas court. He sees no need to pick a fight about who the new powerless liberal judge is. Means nothing other than he’s not an idiot. Ted Cruz however, will not follow his lead, and we’ll see how many other senators will instead play for fox news soundbites.

“Judge not lest thee also be judged”?

  • Sen. Dick Durbin (D-IL), chair of the Senate Judiciary Committee, told the Washington Post that his first call upon learning of Justice Stephen Breyer’s impending retirement was to ranking member Chuck Grassley (R-IA) … to assure him that he wouldn’t “stab him in the back.”
  • “I’m not going to surprise you,” Durbin added. “I’m going to let you know what’s coming so that we can work on it together.”

Charlie Brown (Democrats) unwraps a brand new football (any action whatsoever that the Democrats would like to achieve), and hands it to Lucy (Republicans) with a genuine smile. Charlie Brown, then heads back to run up and kick that football like it’s never been kicked before. “Comity” ensues…

Will the Dems never learn to play by the same rules that Repubs employ? --Sigh–

"He could nominate jesus christ, and I’m a’gin it.”

Well, Breyer and Jesus were both Jewish, so not surprising that Mitch would vote against both.

Actually, I fib. Only nine GOP Senators voted against Breyer, but Mitch voted “yea” – the nays were:

Burns (R-MT)
Coats (R-IN)
Coverdell (R-GA)
Helms (R-NC)
Lott (R-MS)
Lugar (R-IN)
Murkowski (R-AK)
Nickles (R-OK)
Smith (R-NH)

None of them are around, though the current R-AK is the daughter of one of them. Still, it goes to show the difference between the political world of 1994 and today.

So, Biden can stare down the “savvy” Putin and fight his "genius move, " select and nominate an historic Supreme Court justice, battle COVID-19, straighten out the economy … all at the same time?

But, what’s in it for him?

Helms and Lott were cut from the same cloth of “whoever it is, I’m a’gin him or her”.

As it stands right now that nomination is up to the Democrats. Nominate whoever…change the rules…and confirm. There’s nothing the GOP can do about that nor should the Democrats be reserved in doing so after the stunt Mitch pulled on Obama. Exercise their power and do it.

SCOTUS nominees can’t be filibustered, so assuming all of the Democrats vote for the nominee it’s a done deal. Then again, getting all the Democrats on the same page is like herding cats, so someone will have an issue.

Democrats who pursue bipartisanship are TOO OLD to still be in office, or they are in a competition with RonJon for dumbest Senator.

Sen. Roger Wicker (R-MS), for one, likened Biden’s promise to affirmative action.

I liken Wicker’s comment to pro-slavery.

The Confederate racist is trying to insist he’s not a racist, although it’s guaranteed he will unconditionally oppose Biden’s nominee, whoever it is.

He’s trying to weasel-word his way into avoiding accusations, but still doing his dirty deeds right out in the open.

Of course, there’s the problem of New Mexico’s Democratic Senator, Ben Ray Lujan, being currently incapacitated by a stroke and unable to vote on the Senate floor, as the rules stipulate.

I knew about that unfortunate situation but had read that he was/is expected to make a full recovery. Of course, that’s what they always say and perhaps his condition is worse than what we’ve been told. If he can’t perform his duties he needs to be replaced by the Democratic governor of New Mexico. Senate business can’t wait.
