Biden Admin Unveils Abortion Privacy Measures Aimed At Giving Doctors Some Protection From Lawsuits

The Biden administration released a raft of proposals related to keeping abortion-related health information private Wednesday morning. Some of the measures are specifically targeted to shield providers from prosecution, so far the primary way red states are seeking to criminalize the procedure.

Biden proves the power of the entrenched theocracy in America by managing to keep regular Americans from their moral righteousness by a small degree.

Great news in the morning.

The law would open up both the person helping the minor get the abortion and the doctors — even if they’re out of state — to prosecution.

So, we’re out of the ‘states are the laboratories of democracy’ trope and into the ‘states are the laboratories of autocracy’ trope, as the smaller, reactionary polities seek ways to impose their choices on their neighbors?

“Specifically, the rule would prevent an individual’s information from being disclosed [when the individual] …sought, obtained, provided, or facilitated legal reproductive health care”

The freedom to be private.

The right to “none of your business”.

Ol’ Joe knows a thing or two. Republicans have boxed themselves into a corner–their '24 nominee, whether trump or anyone else, will have to support abortion bans to get through the primary–so Joe’s making this a central issue.

Idaho Gov. Brad Little (R) signed a law making it illegal for a minor to cross state lines for an abortion without permission from her parent or guardian.

Prior to Governor Spud signing the fascist bill into law, my governor, Washington’s Jay Inslee, wrote him a nice letter.

Tax the churches and use the money for reproductive healthcare expenses, day care and early childhood education. Then, expand the courts, get rid of blue slips by senators and stop lawyers’ ability to judge shop since we can all agree that judicial impartiality is a fairy tale.

The ruling by judge Know- it - All in TX was pre- ordained. The lawsuit was designed specifically for him and his court . The likes of Crow and The Federalist Society got a very impressive return on their “ investments”.

Biden is limited but there are many attackable facets to this problem. Right wing Republicans are masters of the multi- pronged approach to getting what they want. I’d love to hear suggestions from The Justins.

HIPAA does not provide any protection from a search warrant or other court order. End of story.

And I remember when Idaho had Frank Church. Look at the states which had Democrats as Senators

TN Gore
WV Rockefeller
NE Kerrey
SD McGovern
and more…

It’s unlikely any of these measures will have any impact at all. Most doctors are aware of the fact that any “protection” they might get from the Biden administration might very well disappear the second he’s out of office. If that happens, they’d be at risk of being held accountable for anything they did while Biden was “protecting” them if the political climate where they are practicing is toxic enough at the time.

No doctor in their right mind would think it’s worth the risk unless they’re on some sort of civil disobedience crusade (which, in spite of what you might have seen in the news, is not something most doctors have time for).

This puts the issue squarely where it belongs; medical privacy. It’s no one else’s business if a woman needs (or wants) to terminate a pregnancy. End of story. Also, too, “Judge” Kacsmaryk can go take a long walk off a short pier. The “unborn human” has more rights than the woman carrying it? Please.

If there is any blame from our side it goes to those who neglected to stress the importance of voting FOR THE NOMINEE once the 2016 Dem Convention adjourned. Why?

  • for SCOTUS
  • for Congress
  • and–above all–for POTUS

What do you call a society where judges and politicians are routinely making medical decisions based on their religion?

Theocracy.

IOW, Zombie prez DT could undo the rule, but no one could prosecute a doctor for following the rule while it was in place?

LOL. Can’t help but notice you went back to Rockefeller for WV. Good one!

Well put.

More that the doctor couldn’t be prosecuted based on info that was protected from disclosure at the time of the relevant conduct. If Congress passed a law tomorrow that negated attorney-client privilege, Fat Donnie still couldn’t be prosecuted based on any attorney-client communications he had with his dipshit lawyers back in the day.
