After Clerical Error, 5th Circuit Still Gives Red States Bonus Win In Biden Social Media Case

A Fifth Circuit panel on Tuesday gave red states a win on barring additional government agencies from flagging misinformation to social media companies — a week after it accidentally published an order in error that arrived at a similar result.

The 5th Circuit really is hell-bent on rolling out the red carpet for terrorists to take over all forms of mass-communication in this country without any pushback from the Federal Government that is responsible for protecting the citizens of this country from attacks, both foreign and domestic.

So basically the 5th circuit decided that the Government did not deserve or have a right to respond to a motion and granted the motion, was told the Government did have such a right, so the 5th circuit made a lame excuse, allowed the Government to respond but paid no attention, probably did not even read the Government’s response, and did what it had planned to do before it heard any argument or discussion or even bothered to review the facts and the law.

Am I missing anything?

What would happen if the Biden admin just ignored the 5th Circuit and/or if they released a legal opinion stating that the 5th Circuit’s action is strictly limited to the 5th Circuit? I know that the 5th Circuit alleges that their order is in force nationwide, but nationwide injections from circuit courts are bullshit. The 5th Circuit judges are the ones acting lawlessly here.
