A late night for Justice Department reporters awaiting the government’s filing in the one of the two cases arising from the Mar-a-Lago raid. It finally came in around 11:30 p.m. ET, and packed a bit more punch than I had expected.
It had not occurred to me how damning that “passport” episode was.

The location of the passports is relevant evidence in an investigation of unauthorized retention and mishandling of national defense information; nonetheless, the government decided to return those passports in its discretion.
The passports and their location are solid evidence that Trump himself illegally retained top secret information.

The filing traces the extraordinary saga of government officials’ repeated efforts to recover sensitive national security papers from Trump’s Mar-a-Lago residence and club, centered on a storage room where prosecutors came to suspect that “government records were likely concealed and removed … and that efforts were likely taken to obstruct the government’s investigation.”
The agents also came to doubt claims by Trump’s team that the storage room was the only place where such documents might be found.
I am on a much needed 2-week retreat with family by the sea. I just checked the news for the first time since Saturday and was instantly sickened. I had a Secret clearance for years because I was working on veterans health issues so we needed to know about exposures overseas and troop movements. Any time we needed to review classified material we went to a SCIF, usually in the Pentagon, where we had to turn over our phones and be locked into the room. There was a guard outside the door. I am beyond disbelief that this happened. It’s not just the crime, it’s the potential victims in terms of sources and methods. What is the penalty for treason?
