A Test For SCOTUS, A Test For POTUS

Originally published at: A Test For SCOTUS, A Test For POTUS - TPM – Talking Points Memo

Two of the key questions of the second Trump administration could be days, if not hours, away from being answered: To what degree will the ultra-conservative Supreme Court stop Trump from doing what he wants? And will Trump flatly disregard an unfriendly court order, kicking off a five-alarm constitutional emergency? Trump’s push to end foreign…

How craven is the Supreme Court? How tyrannical is Trump?

Very, and very. The only real question is what will the Court do to protect its own turf.

Hope they’re smarter than Congress and won’t give away their own power.

The Court will be pissing on a lot of the lower federal courts if it sides with the felon-in-chief.

They can’t do shit about their turf, they already ceded it in Trump vs US. Roberts just need to find a way to keep the bribes and junkets coming.

How tyrannical is Trump? C’mon man. He’s as tyrannical as he chooses to be. So far no one’s chosen to halt his tyranny.

Chief Justice Roberts’ stay was administrative. He called for briefs on the issue. Once Roberts has the briefs, he will rule.

While Roberts is awful on most issues, one rule of thumb is he never acts to reduce the power of the Supreme Court. I think it’s likely the Supreme Court will rule against the Trump regime stealing congressionally authorized money and also prevent shuttering of agencies created by law.

It’s not a certainty, but that’s my best guess.

Whether or not the Trump regime refuses to adhere, it’s my hunch they will abide.

Why? It’s simple. Lawless actions to blow off court rulings makes the Court irrevocably hostile to Trump and they’ll go out of their way to screw him in future cases, such as ruling whether or not Trump’s corrupt actions (which happen all the time) are “official acts” shielding him from criminal liability.

Anyway, that’s my thought. Any rebuttals?

May it be so.

It also provides evidence of what could be deemed a high crime or misdemeanor in the event that the House changes hands (although it’s unlikely the Senate would change enough or get angry enough to convict).

How craven is the Supreme Court? How tyrannical is Trump?

How deep is the ocean? How high is the sky?? We’ll see, probably by tomorrow afternoon. I will adopt a wait and see attitude.

To be fair, it isn’t “the Court,” but Roberts and Gorsuch and Kavanaugh and Coney.

Alito and Thomas have no limits to their cravenness, and Justice Kagen, Sotomayor, Jackson are brilliant and far far far from craven!

Trump is lazy and utterly empty of humanity.

That sounds about right to me, but we shall see. I would like to add one piece to your case. If the SC finds for T. Rump, they are telling the Beast to ignore the Congress and the power of the purse (which the Congress have so freely given to the Beast). That means that the courts alone are an official check on the Beast. I don’t think he wants to be in that position, or to put the court in it.
