David Frum’s scenario of how a Trump disqualification would play out is extraordinarily amateurish. If even only one state disqualified Trump from its election ballot then Trump would immediately appeal in federal court. The issue would get decided by the Supreme Court long before election ballots are printed. My intuition is that the Supreme Court would rule in Trump’s favor. None of Jack Smith’s or Fani Wallis’ charges say that Trump incited the January 6 insurrection. The federal courts will not take it upon themselves to assert Trump did something that the DOJ is not willing to allege. While it is useful to pursue the issue I don’t see any state disqualifying Trump unless evidence surfaces of the White House and the Proud Boys acting in concert to plan the attack on the Capitol.
Put me in the camp of try all you want, but the 14th won’t and shouldn’t keep trump off any state’s ballots.
For the “won’t” part of that thesis, check out the “political questions” dodge that the courts invariably use to punt on 4th and inches from their own 30. The 14th does not give courts any enforcement authority, and Congress has unquestionable authority to figure it out for itself.
For the “shouldn’t” part of my thesis, is it really better for a handful of blue states to declare trump ineligible than to just beat his dumb ass again? His cultists need to learn that he’s a stone-cold loser, just like them.
