9th Circuit Trump Judges Enthusiastically Support His Ability To Deploy Military Anywhere At Any Time

How many hickies did these suck-ups leave on TMF’s ass?

Gaza City -or- Portland

Which gets turned into rubble first?

I assume these judges are aware of a law called Posse Comitatus which outlines in restrictive language when and why active duty military can be deployed inside America.

Two of them were appointed by Trump and have been mentioned as candidates for the Supreme Court. They may be aware of the laws prohibiting the deployment of the military in the United States, but these people are ambitious.

This hearing, the Chicago hearing, the indictment of Letitia James…this is not a good day, in a world of not good days.

Just…wow.

The President certainly has personal resources he can deploy as he sees fit, but none of the Executive Branch resources are his resources. Are they not our resources that are entrusted to his care?

This idiot seems to be pushing us toward a monarchy.

The National Guard are the state’s militia:

The Chicago hearing went well. Judge Perry told the Texas NG to go home. There is no evidence they are needed. We’ll talk again in two weeks.

The federal judiciary, after years of Mitch McConnel installing crazy RWers recommended by the Federalist Society, is like a termite ridden home. It is probably worth saving, but it is going to take extreme measures.

What’s bothering me here is that this is the only place I can find this story. It seems a very serious development to me and nobody except Kate is talking about it. What ARE the next steps for Oregon and Portland? Nobody is saying. Is there a plan? Are they keeping it close to the vest. Can the 9th district be made to weigh in en banc? Or is that something only they can decide to do themselves?

Meanwhile on MSNBC last night we had a yuk-fest over Trump’s DM to Pam Bondi and the world. And the usual gang of lawyers telling us how ridiculous it was. Not what I’d call meeting the moment.

“The President gets to direct his resources as he deems fit and it just seems a little counterintuitive to me that the city of Portland can come in and say ‘no, you need to do it differently,’” Nelson said to Oregon’s Senior Assistant Attorney General Stacy Chaffin. “Now, I understand there’s a statute here and we’re going to have to review that, but this goes to the level of deference that I think the president is entitled to in these circumstances. And it’s not all driven by what we see on the streets, it’s also driven by, to some degree, what’s going on behind the scenes, and you don’t have full view into that.”

Good Lord.

The President is entitled to nothing but what the law specifically allows.

Anything else is a judge shirking their obligations and their oaths.

The dumbfuck is sending in troops because of videos from 2020 and thinking that is happening now.

And yes, if the ICE instigated and defined “violence” is old, even if it was last week, it’s done and the troops need to go back to their day jobs.

Really, Judge, how do you know what’s driving it?
We heard this a lot during the Vietnam war. “The President has information you don’t have, so you should just shut up and go along with the President.” Covers for a lot of bad behavior. If you accept it.
