I could be wrong, but I believe that ICE and CBP are allowed to take DNA samples from anyone they arrest or detain for criminal prosecution, under Maryland v. King. Since 2009, anyone arrested by a federal agency like FBI, DEA, ATF has had to give a DNA sample which is put into CODIS. I assume that whenever CBP is enforcing criminal immigration laws, they too can take samples upon arrest. A few years back the EFF was fighting some proposed CBP/ICE regulations to take swabs from kids aged 14 and possibly younger, but I don’t know what happened.
