I heard retired Judge Luttig talk about the decision on Stephanie Ruhle’s show the other night. He said the opinion of the Colorado Supreme Court would “stand the test of time. “ He also predicted that the decision would be affirmed 9-0.

This is a very good piece by Steve Vladek. It is short and he removed the paywall. He outlines how complicated the disqualification clause of the 14th amendment is especially for this court. It would’ve been complicated even if the high court’s credibility were not in the dumper but not much.

Maybe not. They’ll have a majority absolutely, and probably even the liberal justices. But many of the legal experts I’ve been reading highlight the citations to Gorsuch. I can see him voting for the Colorado decision, just to preserve his appearance of consistency.
