Or maybe it’s the husband—Justice Thomas. I see him as possibly eager to please his rabid wife, whose history shows a lust for achieving long term radical goals. Leaking Alito’s draft opinion would be apt to lock in as many as possible of the majority’s Yes votes for the draft opinion. In other words, the Thomases could’ve aimed to secure the votes of everyone except CJ Roberts. This would also preempt Roberts from possibly still recruiting Gorsuch or Kavanaugh or Barrett to his written opinion, which is probably gonna be contra Alito’s tendentious tract.
