I’m going to be catty here and just say it: Whitaker is one of those unfortunate people who aren’t just stupid, as in really, honestly stupid, he’s so goddamn stupid that it’s stamped on his face where you can read it like a street sign. He looks like the big stupid palooka he is. But in case you ever wanted to give him the benefit of the doubt, he opens his mouth and boom, sayonara doubt.

If there are no sanctions for breaking a law, it’s perfectly rational for someone to assert committing (fill in the blank) isn’t illegal. Trump can’t be prosecuted for a crime, nor will the Senate remove him from office. So, whatever he does for all intents and purposes is lawful.

If you jump off a building and float to a safe landing, it’s perfectly fine to acknowledge gravity exists, while taking solace in the fact you are somehow immune to its consequences. You might even be emboldened to brag to others gravity can’t hurt you.

Which is why we have the problem we have. Trump is the sole owner of Trump Org., his father and mother were the partners in the business that Trump renamed Trump Org.

It’s not a crime. It’s a high crime.

Which is an important point, since we always have to keep in mind that impeachment and removal from office is NOT a judicial procedure. This is not about “crimes” in the judicial sense. The impeachment process does not put Trump in jeopardy of judicial punishment, only of removal from an office of public trust. It’s more like a job performance review than a criminal trial.

If Trump is ever indicted for his many crimes, that’s when the full weight of due process and rules of evidence will apply. And that is when he will face judicial punishments like fines or imprisonment.
