True, but also omissions under circumstances in which he would be reasonably expected or even had a duty to act, which is why it was so damning last night when Cheney highlighted all the things he didn’t do that Mike Pence ended up having to do to try to stop the siege and call in backup, etc., things that were technically outside Pence’s authority even, only lying in the authority of the POTUS, strongly suggesting it was not just reasonable to expect Trump to have done them, but that it was his duty to have done so.

What??? The head of government knew there was an attack on Congress and he did nothing to stop it. He did not call: the national guard, the defense department, the DOJ law enforcement, or any other organization that might have stopped it.
What is not “weak tea” in you opinion? Trump saying, yeah, he knew he lost, but he sicced the Proud Boys and the move to hang Mike Pence and kill Nancy Pelosi because he doesn’t like to be a loser?

The conspiracy to defraud statute – 18 USC § 371 – requires one or more acts in furtherance of the conspiracy. It doesn’t say anything about failures to act, and including inaction would be post-conviction SCOTUS-bait.
