She’ll grant the stay, which is from what I understand appropriate for the circumstances, but I doubt she’ll grant him any sort of an extended delay that he’s seeking.

It’s past time to wrap this all up. Justice delayed is justice denied.

They will get the stay, as with the other cases. That’s only because he’s president, so they are being politically careful (which would likely happen with any case like this). That said, the cases themselves should be a slam dunk decision against Trump…if they are not then the conservatives on the SC will show they are wholly a subsidiary of the Republican party, there’s just no other explanation for deciding in favor of Trump in these cases.

A stay here is almost automatic.

There are three things to watch for. First, is the stay conditioned on the prompt filing of a petition for certiorari (like early next week)? I consider this highly likely.

If as stay is granted will the Court, which is considering Trump’s appeal from the decision in Vance next Friday, grant certiorari in that case and in the other pending cases, including this one, next week? I would give this about a 50/50 chance; otherwise it will pend until January.

Finally, if the Court does agree to hear the cases will it expedite them, so they could be heard in February, or even in January, or will it place them on the regular schedule so they will be heard in April? If expedited, we could have a decision in early spring; otherwise, it will be the end of June.

The criteria for putting a stay on the order is based on 2 things:

  • Whether there would be irrevocable damage by not staying the order
  • Whether the case is likely to succeed on appeal

The fact that #2 is absurdly unlikely should make #1 moot.
