A New York federal judge blocked an attempt from President Donald Trump to halt a subpoena issued by the Manhattan District Attorney’s Office for eight years of his tax returns on Monday.

I always thought that his financial crimes were going to be what brought him down. I was wrong, perhaps, in that so far it´s his political acts that seem to be bringing on the impeachment.
But it´s still comforting to imagine that the financial crimes might be exposed. If we´re lucky, even jail!

I’m sure the Mango Menace will now launch a Twitter tirade against the judge in this case. After all his taxes are “perfect” and “beautiful” and he’d love for everyone to see them, but that damn endless audit and all that. Plus I’m sure it’s all somehow Joe Biden’s fault. Yes that’s it…

That would imply that either the United States Court of Appeals for the Second Circuit or SCOTUS would issue an injunction while waiting for the appeals to go through. I’m not sure that they would necessarily do that.

Something like that. I’m never quite sure (and there’s always the options for appealing to the full court if you don’t like the outcome from the 3 judges, so another possible one in there).

Judge Marrero makes some pretty compelling arguments in his decision (cited in the post). Also,

The Constitution does not explicitly say whether presidents can be charged with a crime while in office, and the Supreme Court has not answered the question.

Federal prosecutors are barred from charging a sitting president with a crime because the Justice Department has decided that presidents have temporary immunity while they are in office.

But in the past, that position has not precluded investigating a president. Presidents, including Mr. Trump, have been subjects of federal criminal investigations while in office. Local prosecutors, such as Mr. Vance, are also not bound by the Justice Department’s position.

You have a point, but really he can’t withstand scrutiny by any uncorrupted agency and survive. So while not a dramatic change in his fortunes per se, this is an example of the entanglements gripping ever tighter as they struggle. (Whew—almost gave up and said “tightening noose.”)

ETA always did love the euphemisms legal folks use for arguments they find ridiculous. They’ll be “extraordinary,” or “startling,” “creative,” or “intriguing.”

A President immune from any kind of criminal process would, the judge wrote, “frustrate the administration of justice,” allowing “both the President and any accomplices to escape being brought to justice.”

Here’s hoping the Treasury Dept IG will thoroughly, expeditiously and honestly investigate the WB #2’s complaint about a political appointee intervening on mandatory POTUS & VP audit…
