I thought it was possible to do this…essentially conduct a new census in 2021. I’m sure the GOP would fight it. But I hope Biden is prepared to tell Republicans to stuff it on this issue. And, I hope he’s prepared to sign the Executive Order(s) on Day 1 reversing all the orders signed by Trump.

I thought I once learned that a nineteenth century census was so badly done they scrapped it and started over, but I couldn’t find confirmation on Wikipedia.
Does anyone know if there is precedent for declaring one census inadequate for apportionment and just doing it over?

Vote him out and as many of the Rs as possible. Pass a law that Representatives and Senators are by oath required to “represent” every living person in their district. You know those people who pay taxes at grocery stores and gas pumps. The ones who use the roads and other common utilities. Taxation without representation, how can Rs support that? Run another census. Constitution only says no more then 10 years between, can be less. Pass another law that districts will be determined by a neutral process and fair and equal representation.
I wonder if Biden may, eventually, be able to intervene after the fact. If the count was seriously faulty, wouldn’t there be justification for a re-count? I don’t think one has ever been done, but it would be hard for the GOP to claim it was unconstitutional to do so given Trump’s actions, not to mention the real confounding element of the pandemic.
More likely being in Texas raising money and claiming Democrats are evil prevented him from lying to the American people.
By the way shortchanging Texas in the census is only going to kill off more of his white supporters as rural and small town hospitals continue to close .

This policy will not legally succeed and they know it. Trump and his anti-immigrant ilk hope this will produce an undercount because households will be reluctant to include any undocumented persons.

It’s not up to Trump. If the House doesn’t accept the Census as valid, they can throw it in the trash can and do the 2022 Apportionment based on other sources of data by a simple majority vote. This all much ado about nothing. The Census gets delivered to the Clerk of the House for the new Congress the first week of January. The House can hold it back from the States well into 2021 and well after Trump is gone.
The Speaker can also order the Census Bureau to do a “do-over” to fix the mess Trump’s political appointees have created. The Apportionment is exclusively the House’s responsibility. My guess is the Census Bureau will have the correct numbers in their back pocket when asked for them by Speaker Pelosi next year.
