The Trump-appointed prosecutor who gave an unauthorized interview to CBS about criminal investigations into the Capitol insurrection has left the Justice Department for private practice.
Wonder how soon he’ll start spilling law firm secrets. Partner’s compensation levels, who’s sleeping with who, who keeps raiding the lunches in the fridge, etc…
It is not a crime for a prosecutor to speak in public about pending cases and investigations, nor to speculate about what charges might be appropriate. It is quite likely a violation of DOJ policy, but that does not make it a crime. Still quite unprofessional, however, in large part because it is potentially prejudicial to the defendants if it taints the jury pool.
People see the words “Trump-appointed prosecutor” and justifiably assume there must be something legally skeevy going on. In reality, apart from the dumb interview, it appears to me that Sherwin did a very good job heading up the prosecutorial efforts against the January 6 insurrectionists.
This is a weird one and we will never know his motivation. We can never really know someone’s motivation because one never knows if they are lying about it when they tell us what it was.
I’ve been of the opinion that it was done to undermine the cases down the road as various sorts of appeals based upon prejudice work their way through the courts. Too it might deter sedition charges.
That’s certainly a possibility. I assumed he was letting out how high it went after being frustrated with the instructions he had been given. As in, tell them there is no way former guy is in legal jeopardy.
