Tim Scott On Qualified Immunity | Talking Points Memo

Interesting that the GOP finds something that was the product of “judicial activism” a poison pill. Also interesting that the poison pill is a feature of case law that exists to protect police officers from civil rights lawsuits on the absurd theory that such a violation of a person’s civil rights can occur only in the exact fact situations a court has previously found to be a violation.

So, the Republican Party which touts itself as the party of personal responsibility is NOT the party of personal responsibility? Got it! But, we knew that the Repubs call for selective personal responsibility ONLY when it is to their benefit.

Is it Tim– or Tom? Most certainly token.

OT/ The attached video with special sound track of Trump descending the ramp is hilarious

ETA/ Well, I think it’s amusing.

Perhaps SCOTUS will take another look at this? Interestingly enough, 4 Justices, 2 on the left and 2 on the right want to do just that. They can hear a case with 4 votes, but obviously need a fifth to enact change.

I’m against putting poison pills in legislation just to score political points. But that’s NOT what is happening here.

The so-called “poison pills” are actually integral parts of the policy goals of this bill. Dems should hold their ground, attempt to pass a solid bill, and let the GOP oppose it at their peril. Let the public see who believes what.

(It’s not likely that such a bill would become law during a Trump presidency anyway, but it would serve as a model for a bill that could be passed in 2021 – if the filibuster is sidelined.)

Yep, he favors his left leg/side. Weak on the right.

The real question is if there is a textual argument for qualified immunity in the 1871 civil rights act, and the clear answer is NO! Basically the “conservatives” on the Supreme Court invented a defense to civil rights lawsuits that is NOT in the text of the law. Qualified Immunity is NOT a constitutional defense, it is a change in the law passed by congress which the conservatives just made up.

Hard to think of a better example of how the folks who claim they are “textualists” are actually just big fat frauds.

Congress needs to tell the Supreme Court which created this mess that they are full of shit, and if Scott wants to stand on qualified immunity, great, we will pass a bill in the house, and let the Republicans running for reelection explain why they did not vote for it.

And I might add, that the libertarian right agrees with the left on this issue. See e.g.

https://www.cato.org/qualified-immunity

and a more complete law review article from a very conservative authority (who clerked with a fascist 5th Cir judge) https://digitalcommons.law.seattleu.edu/cgi/viewcontent.cgi?article=2227&context=sulr

The ramp is not as odd as the water. You get old enough, have put enough damage and wear on the body, things do not always work every single day the way they are supposed to.

His drinking was weird. Shaky hands? General Weakness, a joint catch. I have elbow locks from time to time from past injuries and used the other hand to assist. But the way he actually “drinks” is creepy. Short, way short, burst to the lips and he doesn’t even seem to tilt it in naturally at the lip. It is like he hoovers something up like a proboscis. Like a fly on honey. You can almost hear a horrendous slurp in process. Do his lower jaw and teeth not work right? Botoxed, Numb? That is the real thing to look at.

I really don’t care what this sell out thinks about anything. He’s more concerned with what Biden has said rather than what trump has actually DONE.
F Scott.

I agree. To me he just looks like he’s being careful on the ramp.

Yes Tom, I mean Tim, we’re well aware that anything that might increase accountability for police is a ‘poison pill’ for the jack booted thugs, I mean police, and their enablers in the nazi, I mean republican party.

“We are one body in the United States Senate, and people of good heart and good spirit, regardless of what the President does. He can veto a bill, but we should come forward in this moment in history.”

No. You can’t support your president and be of “good heart and good spirit”, that is utter bullshit and why the rest of us don’t have representatives that fight for us in the Senate. There is a war going on, seems like Booker wants to pretend otherwise. What a whimp.

How does this guy look himself in the face while shaving and not die of shame?

Well, politics is the art of the possible.
And right now, it looks like getting rid of qualified immunity is possible.

Purists who can’t accept compromise frequently cause failures by not recognizing the facts as they are.
