I would think that the troofing out of that fake photo by TSFF would be used by Abrego Garcia’s lawyers as proof of animus towards him, and therefore evidence of vindictive prosecution.

I don’t think it’s actually relevant to this case, though - IANAL but this is a vindictive prosecution case, so the question really is “would someone who supposedly committed the same offence with the same facts be prosecuted?” and the answer is pretty clearly no - he was out of the country and the only reason why he was being persecuted was because he was embarrassing the Orange

But this is the definition of vindictive prosecution: they didn’t begin investigating Abrego Garcia intensively until he became a thorn in their side. It doesn’t matter that the charge may have foundation: it’s like comedy–timing is everything.

Let me get this straight… A traffic stop in 2022 in Tennessee which ended up with the state patrol giving him a pass turned into a human smuggling case three years later. If there was anything sinister wouldn’t the state patrol have taken him in? And they obviously didn’t see anything to charge him with in early April 2025 since they closed the investigation on him.

Oh wait - you work for the CF. That means you never take defeat….ever. So make it up as you go along with fingers crossed on both hands behind your back. Trust me said the con man.
