Certainly not. But I am no longer confident that they will not seek out the trans kids’ oatmeal in order to pee in it. Not saying that they will, not by a long shot. But I wouldn’t place any large bets against it (if I were a betting man), because I would have lost a lot of money on some seemingly slam-dunk cases with this lot.

But the thing is that’s not this case. Might they issue a bad opinion? Of course! But they’re not going to use it as an excuse to decide anything that isn’t presented by this case. They don’t just declare whatever they want by fiat.

Re, the VRA: Everything is fine now, so no pre-clearance needed anymore.

That question was actually presented by Shelby County. They didn’t just make it up.

But did the Law say: “When things are fine, according to the SCOTUS, we don’t need pre clearance?”

I personally don’t think that was the case.

The law didn’t say shit about that. It was an open question that was squarely presented by the case before the Court. They didn’t grant review in a parking ticket case and use it to declare the VRA was unconstitutional.

Whether trans kids are “persons” entitled to the protections of the 14th Amendment is not a question presented by this case, and therefore it is not an issue that can or will be decided here.

What can you possibly find “odd” about a conservative anti-Civil Rights ruling on an issue that John Roberts had been championing since he was a baby lawyer in the Reagan White House?

Are you saying John Roberts is not just straightening out disagreements between circuit rulings, and only dispassionately calling balls and strikes? Could he possibly have an ideological agenda and actively uses his position to create laws to advance his agenda? I’m no lawyer, but it sure looks to me like he does a lot of legislating from the bench.

At the store I work for, there is a cafe. Seating for consuming hot food that is made on premise. Attached to the cafe are two bathrooms, one for each sex. I have personally witnessed patrons and, even once, used the bathroom not assigned to my sex (I only get a 15 minute break and can’t wait all day).

I have MAGATs that come to the store every day. Have to wonder how long before they take up one of the chairs from the tables to monitor who goes in and out of those bathrooms.

Dude, the entirety of the point is that the issue has to be presented in the case before the Court. If the issue is not presented in the case before the Court, the Court can’t just rule on fuck-all whatever else it wants to because they’re judicial gods endowed with unlimited dictatorial power.

Shelby County presented the question the Court ruled upon. A parking ticket appeal does not.

Interesting Amicus podcast with the ACLU lawyer who will be making the case.

Interesting how the issue flies in the face of conservatism’s long and strong assertion of parental rights. Abortions? Parents have to be brought in. Masks? Parents get to decide.

In the trans case, the parents in the case studied literature about the issue, obtained expert information, came to an agreement with the child that conforms to medical professionals… but the government is claiming it knows better.

Will the court kill parental rights?
