Not quite what I meant. By not raising federal claims in their state complaint, they have waived them in this action unless they timely amend their complaint to add them. And having waived them in the state court, they can’t raise them on appeal. (At least I’m assuming that Texas appellate rules and law are at least as tight-assed about that than my state is, but I feel good about that assumption as a general proposition).

I suppose if the case went from the Tx Supreme Court, to SCOTUS, SCOTUS could theoretically grant cert on issues that weren’t properly preserved for appeal, but doubt even this court would do that.

Okay, I take that back. Really not anything this utterly lawless SCOTUS would do if it furthered their lawless agenda.

You can amend without leave of court all the way up to 7 days before trial, so that’s not an issue. And this case only applies to this one kid, so they can assert whatever claims they like the next time Abbott pulls this bullshit.

I guess I don’t understand why people who want as many LGBTQ+ people to commit suicide as possible, also line up with the Republican Party on letting Fortune 500 companies pay no tax.

It’s no big deal, we don’t really have motions to dismiss on the pleadings. Special exceptions to pleading deficiencies, but that just makes the other side replead. And if you try to play games by making big changes at the last second, you’re gonna lose that trial date.
