Means they have two conflicting rulings from two different circuits, type of thing which more often does result in the Supremes hearing the full cases and making a decision.

Upending the entire drug approval process, along with changing “standing” rules, they may want to stamp this firmly out.

Alito’s dissent is ludicrous. He thinks partially banning the drug — which was approved by the FDA for 20 years — isn’t irreparable harm.

Any minimally competent judge knows the plaintiffs had no standing, the case was not timely, and the stay resulted from opinion pieces not in the record. It was void ab initio. It’s also contrary to Alito’a decision in “Dobbs,” where he asserted elected officials decide on the issue. Here is one judge stopping the primary medical abortion medicine for the entire country.

The reality is Alito is a theocrat seeking to ban abortion in any way possible. The law and precedent mean nothing.

Score. This is the best possible outcome. Punts for a couple of years while the appeals play out. SC can’t afford to do anything outrageous with all the ethics dust swirling around not just SC, but Kaszmaryk. Would have been nice if they had kicked the whole mess based on standing, but methinks they have to have the whole merits discussion on that.
