Someone in the majority leaked. So to lock in the votes to overturn Roe and so to lessen the blowback and hope people forget as we get closer to the midterms.

I suspect it was leaked for the opposite reason: to generate pressure to influence or prevent this from being formalized. And it seems to have at least made an impact. Note the spokesperson’s response:

Although the document described in yesterday’s reports is authentic, it does not represent a decision by the Court or the final position of any member on the issues in the case,” Court spokesperson Patricia McCabe said.

I think the gang of six is already in damage-control mode. They were hoping this would only happen after the decision was final. (And Roberts owns this as well. A “dissent” saying that Roe is still the law of the land, but a 15-week ban is fine, is complete bullsh*t. And he knows it.

“This was a singular and egregious breach of that trust that is an affront to the Court and the community of public servants who work here. I have directed the Marshal of the Court to launch an investigation into the source of the leak,” Roberts said in a statement Tuesday.

“To the extent this betrayal of the confidences of the Court was intended to undermine the integrity of our operations, it will not succeed,” Roberts said. “The work of the Court will not be affected in any way. We at the Court are blessed to have a workforce – permanent employees and law clerks alike – intensely loyal to the institution and dedicated to the rule of law. Court employees have an exemplary and important tradition of respecting the confidentiality of the judicial process and upholding the trust of the Court.”

I believe this is the case; and it could have been leaked by anyone with access (I assume this includes clerks).

If ever there was a question of what is legitimate and what isn’t, this pretty much confirms it.

The opinion leaked is legit.

The SCOTUS is probably not.

Well, the 7-dimensional chess argument would be that Roberts wants the decision to be slightly different than this draft while still striking down Roe, and acknowledging that it’s real will add pressure for that change. Of course that would make Roberts a suspect as the leaker too, so who knows.

Which is the reason why it was leaked now. The Right believes they’re on the precipice of victory. If, for some reason, Dems can’t get out and vote in large numbers to overcome this, this country is no longer united. It’s just America. And, maybe, that’s the reality we have to live with now. It’s all gone too far.
