The four hour drive through the scenic countryside from the nearest major urban centre and airport is a relaxing side benefit. OK if you’re a party to the case, and a major (intentional) deterrent if you’re press or an observer; the hearing in the mifeprestone case wasn’t announced until the last minute and folks had to scramble to attend.
I’m thinking that last sentence should read:
Somebody needs to say in plain, clear speech what the GOP has done.
I mean, if we’re talking about “catching up with the times,” then there’s no need to pretend that the corruption of the US judiciary system isn’t already a fait accompli.
Not every judge, of course. But the system already has multiple paths almost guaranteed to lead to a conservative win, all the way up to the Supreme Court.
We can still fix it … eventually … I think. But needing to fix it is evidence that the GOP has already corrupted it, not just trying to.
Do you understand just how gigantic the Northern District of Texas actually is? I’m gonna be pissed if I have to travel to Amarillo for a case I filed in Dallas.
I was only proposing to redistribute the cases from the division that was lacking a judge (or only has one).
Regardless, if you have a lot of land and not many people somebody has to travel. Plenty of people seem happy to travel to Amarillo to get a judge which will rule their way.
How would you propose managing the allocation of cases in Texas to eliminate judge shopping
By making D.D.C. the exclusive venue and jurisdiction for all suits seeking injunctive relief against the United States (or any subdivision thereof) that would affect the rights of anyone beyond the immediate parties to the case
If it’s not political then it’s OK? An accusation of “judge shopping” is hollow?
You ever heard of a race to the courthouse? You know why they’re bothering? It’s because the first to get there fixes the venue and the pool of judges, and everyone has their preferences on both based on the nature and quality of their respective cases.
If my equipment financing company gets in a payment dispute with a borrower drilling for oil out west, I damn sure want that lawsuit to be in Dallas instead of Midland. Is that judge shopping? Who cares?
Or alternatively, injunctions only apply to the District or Appeals Court jurisdiction the case was filed. Unless the Federal government moves an agency to the District of North Texas, they’ll have to file the case in DC for it to apply to Federal agencies.
Bad idea. Random shitty rulings across the country, no consistency until SCOTUS, which, I should remind everyone, can and should be legislatively bribed into retirement.
What the hell does this whining matter. Without control of congress the Democrats are helpless. There is a good chance we will win the house in 24 but there is little chance the senate will move much one way or the other. Not enough to get important legislation through.
Much better than my attempt!
McConnell keeps proving that his time under Obama was crucial to conservatives. Dems recognized the potential problems back then but failed to curb the situation.
Abolishing the Northern District of Texas would be a good start. Then the attorneys could jump in their cars and sing “Houston by Morning.”
