The optics of this kind of delay are very poor when the House subpoenae themselves expire on Jan 3, 2020, thus mooting two of the three cases.

Correct. Trump’s arguments are such obvious bullshit that the appellate courts would never have stayed enforcement if he were anyone other than the Republican President of the United States. Appellate courts moot stuff all the time by failing to stay enforcement, up to and including executions of real live human beings.

Today is the commemoration of another attack on America by a foreign military.

(Only in this case, it was the Imperial Japanese Navy, rather than the GRU.)

It’s Pearl Harbor Day, not that Trump would know it, since it’s a 78-year-old commemoration.

He’s only interested in younger, more-attractive commemorations.

Doesn’t mean they won’t do exactly that.

The correct thing is for the SCOTUS to decline to take the case because 1. Trump has no standing and 2. There is no lower court disagreement on whether the banks have to give the House the records (they all say the banks have too).

However, all it takes is 4 justices to say they will take the case, causing it to be delayed till May/June.

RBG was just following procedure here, but it would have been better if she didn’t and said Trump needs to stop abusing court procedures and follow the law

Well it’s RBG, so not too disappointed.

I’ll be upset if after Dec 13 the court decides the WH needs more time to develop its appeal. Trump and his crew have had months to hone their appeal. If they haven’t got their arguments together by now, more time won’t help them.

The Court already ordered expedited briefing in the Mazars case. Trump’s certiorari petition was filed on Thursday and is set to be granted or denied at next Friday’s conference. If review is granted, it will be set for oral argument, possibly on an expedited basis. If review is denied, Trump’s arguments against the third-party subpoenas will be dead, and his arguments against direct subpoenas will be on very tenuous life support.
