SCOTUS Stays House Subpoena For Trump Tax Returns | Talking Points Memo

Earlier Monday, the House said that it would endorse a 10-day delay to give the justices more time to consider legal arguments.

House General Counsel Douglas Letter suggested in a letter Monday he could file briefs on Friday outlining why a subpoena to Trump’s accounting firm for financial information should be allowed to go into effect.

Not if Barr subpoenas Mazers for the tax files and/or raids them to prevent their ‘unconstitutional release’.

Don’t bet against how low this crowd may go.

For a stay application, a short time frame is not unusual. What the House should do is in its response request that the Court condition the stay on a prompt petition for certiorari and a request for an expedited briefing schedule. I would expect that the Court will do that, and consolidate argument in this appeal with that in the Vance case (New York grand jury subpoena).

Though all the cases focus on the issue of whether Trump’s taxes will be released to various investigating bodies, they encompass broader questions around presidential power, the rule of law, and whether long-settled issues over the legality of investigating the president will remain in place.

Uh, Josh those tax returns also speak to questions of how honest/law-abiding the president is and if he might be compromised financially.

Depends on the briefing schedule. Petitioner usually has 90 days to file for certiorari, but I would expect an expedited briefing schedule to be ordered by the Court or agreed to by the parties. Either way, this temporary stay is almost certain to be extended until the Court has made its final decision.

Weird thread hijack, BTW. This is an article about the legal issues surrounding Trump’s tax returns, not an invitation to re-hash Clinton’s issues with “the left” for the 18,000th time.

House counsel had offered to respond to the motion to stay by Friday of this week, so Roberts actually moved it up by one day. My guess is that the temporary stay will be extended on Friday, and likely with an expedited briefing schedule being entered as well.

Good explanation of the process. I would clarify one detail.

The order says the stay will remain in place until two things happen: (1) receipt of the House response, and (2) further order of the Court.

So I wouldn’t set an alarm for 3 PM ET on 11/21/2019. Instead, I would expect the Court to take some time to look over the pleadings and issue a written order. With luck, that could be 0 to 5 days. Without luck, it could be longer.

He also cited international opinion in that too, which he also said should never have any bearing or be used to determine a domestic legal case when it came to the death penalty however. Because you know, conservatives for a while now are not arguing in good faith.

We cannily hope the Chief Justice will do the right thing here. I think the law and congressional practices are both on the side of release.

A temporary stay pending a response is routine in a situation like this involving a “once the toothpaste is out of the tube . . .” situation.

If the WH defies the SCOTUS, I think public opinion will begin to move away from them.

They will be saying, essentially, “No one tells Trump what to do. No one.”

That may appeal to his 30% base, but most folks are going to look at that and think, “You’re not a king, Donald. Obey the law.”

And I think that’s where we, as a society, need to focus.

“Obey the law, Donald. Stop telling people to ignore lawful subpoenas. Stop intimidating witnesses. Come clean.”

It won’t happen, of course, but a citizen can dream, can’t he?

Before everybody goes ape-shit about this: THIS IS NORMAL.

SCOTUS is giving the HOUSE Attorneys a chance to respond. NOT Trump’s attorneys.

The Supreme Court ordered the House to respond to Trump’s request for a stay by Thursday at 3 p.m.
That is pretty quick for a SCOTUS decision.
