Implied but not so much explicit in the article is that federal regulations act as a safe harbor for many corporate actions. Comply with the regs, and it’s much harder to sue you. If there’s no clear regulatory authority for what you’re doing, anyone (especially anyone with deep pockets) can sue you for the damage you’ve ostensibly done to them or hypothetically plan to do to someone who might be them, and you’ve got to spend all your time defending the suit. If you do business in a circuit with a few loony judges in it, expect to be hit with an injunction forbidding actions that are almost certainly perfectly legal.
Or in cases where someone actually has been injured, do we have to litigate negligence even if the company(ies) involved did everything required bby regs to make their products safe? And in the current environment, decisions based largely on whom the judge wants to stick it to.

Enough young Federalist Society judges have been installed in many Federal courts by now that a good number of those lawsuits will be decided entirely on partisan grounds. Or (b) venue shopping will ensure all anti-regulation lawsuits will be heard by an anti-regulation judge.

I completely agree. But this is not the first and won’t be the last time we as a Nation face this challenge. I’m currently reading (just 100 pages in) Peter Canellos’ book, The Great Dissenter: The Story of John Marshall Harlan, America’s Judicial Hero, which has helped drive this home. Talking about SCOTUS and popular similarities. I do believe that it will get better, as we are once again dealing with racism and “white supremacy”, and perhaps we’ll do a better job of it this time. It took decades back then, but change started. Let’s work to finish the job.
The Republican leadership plan is to make voters feel helpless and small, and to give the impression that everything is out of control of the typical citizen. Media is controlling much of the message, but not all of it. Does it look dark and hopeless? Of course it does. But that is all - it looks dark, but doesn’t have to be (and isn’t in reality) that way. I do believe in the spirit of this Nation, but we need to stop think as individuals and start thinking collectively.
I do not truly know their motives (although I bet I can come very close), but I understand the consequences of their actions. The Republican Party needs to be stopped. Will it be dramatic? Perhaps. They are playing poker and are master con artists/bluffers - that is their true strength. We need to challenge them out in the open on every front, and still get done what can be done.
Look at what the President accomplished during the Republican’s last budget threat a few months ago. Too frequently, we resort to instantaneous worry instead of looking at and acting for the long term. He and his team understand politics and how to get things done - and that is what the Republicans are most fearful of, as they lack any ability to govern the country for all. It’s messy, but that is the nature of a constitution/federal republic. The fight needs to be continued - endpoint be damned.
I do believe it will get worse to some extent as the Republican Party knows that demographics are and will continue to move against them. We need to stop being frightened every time one of the idiots opens their mouths or tweets some bullshit. Call them on it and keep moving forward. Will we need to eliminate the filibuster? Perhaps. I’d keep that threat front and center. Same with changing the SCOTUS from its previous form to something else.
Your points above are on target. But there are solutions. Not instantaneous ones, but they should not be expected to be that. Fear of change should not let us accept their nonsense. That just plays into their plans. Will people get hurt in the meantime? Unfortunately, yes, no doubt. And that is just another reason why I am fed up with Republicans using religion as a weapon. Their collective religions are fraudulent. It’s not about helping people and living together but maintaining the control of the masses by a small few. Sorry - that will never win out if we keep pushing back.
We just celebrated July 4th. The Constitution is a marvelous document - but far from perfect. Let’s all work to make it so - for all citizens, not just a few self-anointed bastards who wish to use everyone else for their gain. Game on - we will outlast them. The question is simply how long will it take.

One reason Saint Ronnie was hired was to sabotage the agencies. He had only modest success.
So now they’ll do it with corrupt SCOTUS judges, bought and paid for.
Clarence Thomas was one of the saboteurs. He crippled the EEOC. He did his job, mon.
This fucking corrupted court has gone full jihad on us.

Judges and Justices are expert in all sort of areas. Like clean air, clean water, fishing, energy and of course medicine. After all who could forget the SCOTUS practicing medicine w/o a license in the Dobbs decision? Just think… a law degree makes one expert in every field we know of.

I agree with both you guys and the issues you highlight. I’ll add one more, climate change. Most of the stupid stuff that we did in the past could eventually be worked out without destroying the country/world. This is not to excuse our past racism, sexism, economic oppression, etc. but to point out that all of those past failures did not result in the type of catastrophe we now face. We need to be full speed ahead right now and this court has the ability to derail any progress we attempt to make.

Chevron is unconstitutional and SCOTUS should get rid of it. Courts should not defer to agencies on simple statutory construction. I appreciate that this will hurt some environmental regulations, but it’s important to keep in mind that Chevron deference can lead to bad policy outcomes too. For example, in animal law, it enables agencies to do things like deem birds to not be “animals” for the purpose of extending regulatory protection. In other words, Chevron deference can be used by conservative agencies to help industries avoid regulation. It’s a double-edged sword policy-wise, and a pretty clear-cut violation of legislative power by the judiciary. Get rid of it.
Ah, Hell, Why don’t we just not have any rules at all. Put those damn kids to work! Work people until they drop in the traces, there are more to fill the slots. Libertarian Heaven!
