I wish the article specified whether it was his PERSONAL phone – which, frankly, he has every right to be upset about – or his WORK phone – which is NOT his property. I hope it’s his work phone, which is only supposed to be used related to his job (see Strozk, Peter).

The Speech and Debate clause was generally interpreted as to whatever you say on the floor of the House or Senate, a member of Congress can’t be sued. Which is how Joe McCarthy was able to slander people for a decade before dying in the drunk tank at Bethesda Naval Hospital.

Perry’s a congresscritter, Strozk was a USG employee at DoJ.
I don’t think congress provides members with recallable phones whose use is governed in the same way as those in executive branch offices.

It isn’t, and so far the courts have imposed limits. But Graham is pushing well beyond the boundaries and with the current majority on the Supreme Court there’s no guarantee.
