The statute does not prohibit immaterial errors being used in determining whether a vote can be counted, only in whether the voter is eligible.
If the state requires voters to insert their ballots into the ballot box, and the voter instead deposits it on top of the ballot box, the 1965 CRA does not require that ballot to be counted.
