The DOJ has to “identify each discovery document by name, date, and author” and “provide transcriptions of all handwritten notes.”

Emptywheel is all over this – there is basically no way that the DOJ can respond to these orders without revealing that they doctored documents in bad faith.

Flynn doesn’t need to worry. If Trump loses (please!!!) then his pardon will come down on January 19, 2021, mooting the DOJ 180 on January 20.

These are Federal charges. Why the hell doesn’t Trump just pardon him and save the DOJ the time and embarrassment (and possible troubling revelations)?

The only reason it has not yet happened is because Trump believes he can ride out any political storm by not taking any position at all, and heaping calumny and innuendo all over the place. He is averse to actually pulling the “pardon alarm”.

The exception was Roger Stone, and we can only speculate on why.

Very nice! DoJ prosecutors can decide whether they want to perjure themselves for Flynn, Barr, and Trump, and ruin their careers or come clean. Flynn should really have settled, because the DoJ is getting new management in January.
