Neomi Rao Understands What It Means to Be a Trump Judge

This article is part of TPM Cafe, TPM’s home for opinion and news analysis. It was originally published at Balls and Strikes. For a full year, U.S. District Judge James Boasberg has been trying to hold the Trump administration accountable for violating a court order that prohibited the government from arbitrarily sending immigration detainees to be imprisoned in El…

It’s a shame what our justice system has been reduced to. He’s taken more control of the FBI, DOJ and our courts than I would have thought possible.

Orban eventually lost. So will the Fanta Fuhrer.

Excellent analysis. Spot on. Rao is a tapdancing clown in constant audition-mode for the circus that SKKKOTUS has become. She’s dancing almost as fast as Judge Ho down in the 5th Circuit.

I’d be extremely embarrassed to have a record of consistently doing the evil bidding of someone both so venal and so stupid. I wonder what prevents her embarrassment? Aspirations to knock Aileen Cannon out of her reserved seat on the Supremes so that she, Neomi, can be the one with ultimate power and walk in the footsteps of Clarence Thomas? Or what? …

Either I have forgotten, or never found out how much money are we paying El Salvador to house these men in a El Salvador prison? And t what is happening to these men now.

Trump won’t appoint Rao to the Court. She’s a woman of color and not “hot.” She’s not from “central casting.”

It will be a hard, hard lift, but we need to achieve the impeachment conviction threshold in the Senate, and then go about ridding the Judiciary of FedSoc nazis. Yes, I assume we will have the House.

I’ve been following this case and the absolute bad luck of getting Neomi Rao and another Trump judge on the panels (Katsas first time round, then Walker). Their administrative stays in the two cycles have totaled close to 12 months. BTW, I did a AI query the other day to see if Neomi has ever ruled against the Trump admin. Alas and alack, nope, never. And the list of her partisan rulings is long, long, long. She should wear a MAGA hat on the bench.

Ah, but the good news – the DC Circuit Court of Appeals will rehear en banc and reverse Neomi. Ah, but the bad news – the Supreme Court will likely reverse the ruling in the en banc re-hearing. Neomi is corrupt, but so are the Supremes.

Rao is doing exactly what everyone said she would do when she was nominated and confirmed on a 100% partisan vote. She is exactly as awful, both as a lawyer and a human being, as expected.

Along that line, as a young law professor at the Antonin Scalia School of Law, Rao defended the right of Americans to toss dwarfs (or, for you Tolkien nerds, dwarves)…

Wikipedia:

Rao was criticized by disability rights activists such as Rebecca Cokley for a 2011 law review article[18] and a blog post where then-law professor Rao expressed opposition to bans on dwarf-tossing.[19]

I believe that “Understands What It Means to BE a Trump Judge” means you have different standards for different litigants.

Saving his ass is more important to him than her face.

She just has to work twice as hard to be despicable and so far she has managed nicely.

Boasberg should have put Rubio in jail for that “oopsie” comment. Staying an order for appeal is barely different from no order at all. In fact in this case it is no different.

“Rao’s opinion is essentially a Truth Social post with a thesaurus.”

Zing.

The ACLU filed an emergency lawsuit before the proclamation was even online, and told Boasberg they had reason to believe the administration was already putting people on planes—preparing to send them to a foreign prison known for torture and other human rights abuses without so much as an opportunity to prove their innocence.

Right there. Apart from the issue of removals is the inversion of due process. Our system is predicated on having the government prove one’s guilt.

Neither Rao or Cannon will EVER be confirmed to the SCOTUS. Both Thomas and Alito have no plans to retire, (they are already interviewing new clerks for 26/27), and once the Senate Majority leader becomes a Democrat, Trump will get ZERO new Judges confirmed to any federal court. You can quote me.

True that. But…Aileen Cannon is also singing and dancing in constant audition mode, as is that idiot in Lubbock…Kacsmaryk??

So we’ve got four women on the court (Boney Carrot, Sotomayor, Brown-Jackson, and Kagan). I don’t think the Trump-turd will appoint a fifth woman. If I were a betting man, I’d place a little money on Ho. Maybe Donnie Dumbshit will ask him to sing Tiny Bubbles in his interview in the Oval?

Speaking of Donnie Dumbshit, has anyone else noticed that he’s sabotaged the negotiations to end this idiotic, immoral, and illegal bombing campaign and naval blockade of Iran? All who are surprised by this development should please put on their shocked face immediately.

Beg your pardon, but that assumes facts not in evidence, to wit: that he currently has the mental capacity to understand exactly what will save his ass.

His ass desperately needs to plucked out of the bubbling cauldron that is his splendid little war crime in Iran. The Iranians made the biggest goodwill gesture available to them and announced that the Strait of Hormuz was open (albeit with mild conditions–coordinating passage, basically).

That is exactly what Donald Shitler demanded. “Open the Strait,” he said. It was his move: every negotiation theory I’m aware of says that when your counterparty makes a good will gesture, you need to return the act in some way. Obviously, the response the Iranians sought was to withdraw our Navy from the Persian Gulf and suspend the blockade. Donnie Drumpfshit didn’t have to do both–he could have suspended the blockade and left the frigates in the Gulf for the time being. He could have left the blockade formally in place and withdrawn the frigates from the Gulf. He could have done something somewhat unrelated and eased sanctions on Iranian oil currently at sea. He did none of those things: he insultingly announced that the blockade was staying in place, seized an Iranian cargo vessel, and reiterated his war crime threats.

He doesn’t know what to do to save his worthless ass.
