I have a feeling that Mo, or his lawyer didn’t think this through and thoroughly when they decided to open this can of worms.
I would think that if it’s found that he is a federal employee then there’s a lot time we’re owed that he hasn’t been present in Congress. That he hasn’t filled out the appropriate paperwork, nor attended the mandatory training sessions.
Also more to the point who hired him?
Well Mr. Brooks forgets that a portion of his constituents voted for Joe Biden And challenging the presidential vote in Pennsylvania and Arizona seems to be outside the realm of constituent services, as mr. Brooks does not represent anyone in either of those states
is guilty of causing the work space to be unsafe, and downright hostile.
During a “Stop the Steal” rally hours before the Capitol was breached, Brooks parroted Trump’s falsehoods of a stolen election and asked the crowd whether they were ready to sacrifice their lives to challenge the election results.
This certainly doesn’t sound like someone engaging in protected speech or actions within the scope of his federal employment.
If I take a step back though, it seems remarkable that his first argument isn’t that Swalwell has no basis for a case or that it’s frivolous or that he did nothing wrong, it’s that he’s too privileged to be sued. Maybe when the judge shoots this down, that argument will come next.
I guess Brooks is saying if he truly believed in the lie -against all the evidence and failed lawsuits -he shouldn’t be held responsible.
Alabama has these conclaves where things are kind of fluid.

Well, that will be a tough nut to crack. In their brilliant legal minds I’ve no doubt inciting an insurrection is clearly wrong, but only if Democrats attempt it.

And if he truly believed that the vote was invalid (he did not and he does not), then he needed to act in his official capacity to coordinate with the correct authorities, not speak to a rabble who, as you pointed out, are not even part of his constituency.

With Tommy Tuberville as my witness I will prove that oath clearly absolves me from any responsibility for my efforts to incite insurrection against the authority of the United States, to delay the execution of any law of the United States, or to seize, take, or possess any property of the United States. I was clearly justified in representing the interests of my constituency who are still aggrieved over the War of Northern Aggression.
O/T but how about a bit of news about an ex-President who is a decent human being. (Also a believing and practicing Christian; turns out it is actually possible for the combination to exist, despite what you might read in this forum from time to time.)
