Actually, although Gotti had Paul Castellano whacked in front of the Palm Steakhouse in NYC in 1985, it wasn’t until Sammy the bull Graviano worked with the prosecutor in 1991 that they were finally able to send Gotti away for life.

I’m not sure the idea of charging him with perjury/contempt will pan out.

If he lied when he admitted he made the statements, that would support perjury.

If he “lied” when he admitted the statements were material, that’s a different story. (I’ve read that the DOJs new position is that the statements were not material.) It’s more of a legal conclusion than a factual matter. He will claim that he relied on his attorneys, and the government’s attorneys, in reaching that conclusion.

Flynn needs a good masking.

show cause as to why Flynn should not be held in “criminal contempt for perjury,” while citing both federal law and rules of procedure that allow for criminal contempt sanctions for misconduct in court.

Marcy Wheeler’s been saying for some time that a portion of Flynn’s two pleas are contradictory, meaning that in one of them he de facto had to have lied to the court in his plea. Looks like da judge is thinking that way too.

Could he have lied when he said he was cooperating? The first time his sentence was postponed the judge suggested he cooperate harder. Did he make any promises in court to that effect?
