McConnell would have blocked her successor anyway. He and Cruz publicly stated they would let the number of justices dwindle until they could stuff SCOTUS with their favorite extremists.

If they have him whacked, it’s too obvious. But they can harass the poor man into the ground (or even better, harass his kids and grandkids. The national GOP doesn’t even need to do it themselves; they have Fox news, OAN, and the increasing Kristallnacht caucus to do it for them.

That would take a constitutional amendment, which ain’t happening. Senior status is already in effect at the circuit and district levels, without controversy. Making it mandatory has not been tried yet, but I see no good legal reason why it wouldn’t be upheld as constitutional (other than the fact that the justices themselves would ultimately decide the matter, and they would have an obvious self-interest).

And the defendant doesn’t even have to have ever served in government. If the House wants to impeach a ham sandwich and the Senate convicts and declares it ineligible to hold future office, that ham sandwich will never be president.

The Democrats control all three branches of government Obama’s first two years. If you’re talking about the filibuster for judicial nominations they could have just gotten rid of that a bit earlier than Harry Reid eventually did.
