Apparently Preet Bharara agrees with you to this extent - he said on his Stay Tuned podcast this week that Nadler delayed pushing this into the courts for several months, and if he had pursued it earlier we would already have this decision and possibly the appellate decision already in pocket. He referred to this as unfortunate timing on the part of the judiciary committee.

It seems as if every legal decision is going Trumpā€™s way. Thereā€™s a pattern of judges ruling one way, then reversing. Not to be too pessimistic, but Trump seems to be winning every legal battle. The rule of law has been suspended until a Democrat takes the WH.

I donā€™t actually blame Nadler. While technically he was authorized by a resolution of the whole House on June 11 to go court for both McGahnā€™s testimony and the Grand Jury materials, in practice the House Counselā€™s Office is controlled by Pelosi ā€“ so she calls the shots regarding the timing the lawsuits were filed (and everything else) concerning the lawsuits (including the briefing and hearing schedules that were agreed upon by the House and DoJ.)

Yeah, but the fix is in. This is all a delaying tactic, and Roberts has already indicated heā€™s perfectly fine with delaying everything to make impeachment more difficult, or possibly even until itā€™s effectively moot because the election will be in full swing. There is no honor or respect for law among Right Wing Reactionaries. Better get used to it.

my recommendation ā€“ pick a small area, and make it your own. Mine is court cases pursuant to impeachment ā€“ and that keeps me quite busy.

Speaking of which ā€“ Kuppermanā€™s lawyer just filed his brief in that case ā€“ and its in opposition to the motion(s) to dismiss his case by both the House and the DoJ. Going to go read it now.

ETA: read it. Kuppermanā€™s best argument is that he remains subject to punishment for failing to show up for his subpoena. And he wants to add the sargeant at arms to the suit. Iā€™ve explained further in my impeachment court case thread.

But more interesting is that the House has filed its response to Team Trumpā€™s motion to dismiss ā€“ and cites the McGahn decision 13 times in todayā€™s filing.

I am turning down an invitation to Thanksgiving dinner in anticipation that there will be breaking news. (Also, they eat at 1 p.m., and the whole point of holidays is sleeping til noon.)

Honestly it takes an extraordinary circumstance to make me miss Jeff Sessions but William Barr is that extraordinary circumstance.

a three judge DC circuit court panel has just issued an administrative stay until at least Jan 3 (when oral arguments have been scheduled) in the McGahn case. More details here.
