Requesting the judge to stay in a ruling she has not issued yet is an attempt to goad the judge into overreaction as a basis for appeal. It’s an act of desperation.

In the fictional film The Verdict, the outcome of the case depends upon plaintiff’s counsel Frank Galvin (Paul Newman) finding the right witness, whose identity and even existence the defense had tried to keep secret.

There may be gold in those documents.

OK it is now November 9, 2021 … how can it be further assured that the window stays open?
given that the National Archives is expected to release the documents by Friday, November 12th…
would it have been better to have let this request languish … and then squash it on Friday afternoon …

what would be wonderful would be for all of the toxic damning documents to make their way out into a near infinite number of news outlets - and start buzzing about the whole world - with no way to undo them …

It certainly sounds promising. We’ll see. Even if a release of documents actually goes forward though none of it will be made public unless it’s leaked. Baby steps I guess.

Seems to me the ruling should leave a minimum of time before the deadline when the documents will be turned over. tfg’s lawyers will have to be sitting around (billing hours all the time) waiting to send their pre-written emergency request for a stay on appeal. (Bonus if the ruling is written in a way that renders the pre-written request and the pre-written appeal nonsensical.)
