So, surprisingly, when legal scholars were asked to comment, their reaction to the legal position of wait, let’s see…(checks notes). Ok, okay, so it’s an intentionally transparent proxy for the President of the United States. And, being legal scholars, they processed this as ridiculous and trollish. Rather than, say, a radical ideological manifesto from the nihilistic authoritarian party presently demolishing the entire infrastructure of democracy and rule of law with the avid assistance of John Roberts et. al.
The collapse of rule of law is a literally existential event for people teaching law to mostly intelligent and young adults whose brains and judgment are still in the final stages of development. Are you supposed to teach these kids the rules of a system that is collapsing before our eyes? Turn them into liberal counter-revolutionaries? Train them to be nihilistic psychopaths and sycophants who translate the Leader’s caprice into civil power? Train Them Up into the Law as you knew it under the theory that this is all just a passing phase and, even if it isn’t, someone needs to preserve this knowledge?
Just a specific application of the greater moral crisis the entire profession is processing and, to the maximum extent possible, evading though. It’s why I took the coward’s way out and bailed early. Because ever since Citizens United and the redistricting catastrophe of 2010, I’ve watched the entire judiciary become worse. In every possible way. Dumber. Meaner. Less responsive to legal argument that was contrary to an ideologically determined outcome. I didn’t see Trump getting reelected, but I didn’t see any chance it would all get better again.
But it’s a lot easier to walk away from corporate practice than from a tenured chair. Especially one you know will be filled by someone worse if you leave it.
I don’t think you call what Roberts does with the courts “management.” And if it is, he sure is shitty at it.
Wasn’t there a WW|| comedy with the lead character named Mr. Roberts? But at least he got things right.
