“I’ve decided to take a time out from my litigation against Liberty University, but I will continue to keep all options on the table for an appropriate resolution to the matter,” Falwell told the newspaper in a statement.
In other words, he chickened out before LU could shit all over him in the litigation, but he still wants to get paid to go away.

I’m sure once his lawyers explained the term “discovery” to him, this was really all he could do.
On a somewhat tangential note, it’s a bit misleading when journalists claim that the photo of Falwell and that girl on the yacht showed the pair in some compromising position with their “pants unzipped.” I’m not excusing Falwell’s behavior, particularly as it behooves the president of an evangelical school, but it’s clear (at least to me) that Falwell, perhaps a bit tipsy, was joking around and imitating the pregnant woman’s midriff-baring shirt and protruding abdomen with his top pants buttons undone. That said, prominent university presidents generally don’t clown around like that with their wife’s assistants – and we all know now about the Falwells’ personal peccadilloes – but some scandalous piece of pornography this was not.
