I’m no lawyer, but does that mean basically “heads we win, tails they lose”? Because just crossing the Mexico border without permission is some kind of crime now, so none are innocent.

It’s only a misdemeanor. And unless they catch you in the act, they can’t prove it. Just being here without permission isn’t even a misdemeanor, just a civil offense that might cause you to have to pay a fine (and get deported).

I read this week that Canada won’t even allow electricity across the US border, if the new Trump-Hawley tariffs are imposed.

(Yeah, I know Josh Hawley isn’t even involved yet, but the parallels to “Smoot-Hawley” were irresistable. The old history books gave Smoot-Hawley a lot of credit for kicking off the Great Depression.)

Oh dear, but how people many make a group? And how does anyone prove that? Did they have a group certificate to make it official? If brought by force on a boat, did they come as a group or individual? I mean, this has all got to be very legal as per provable in a court of law as to up or down, and that means measurable.

My guess is that the measurable component will the amount of melanin in the skin.

The phrase “subject to the jurisdiction thereof” in the amendment limits it to only those with allegiance to the United States, they argue — a reading that they say would exclude undocumented immigrants.

So, I speak under correction, as a non-legally-trained layperson, but … can these undocumented immigrants not be arrested by federal agents? Charged with crimes? Deported?

Well then, how in seven netherhells would they not be “subject to the jurisdiction” of the United States?
