Why was that interrogation video released?! I hope this isn’t going to result in a mistrial because the testimony was tainted.

This is normal stuff and the right choice. Putting the evidence out there, which may or may not end up seen in court during the trial, risks a claim of a tainted jury pool and overturning convictions on appeal because of that.

As noted above, that would serve as the basis for a finding that the videos being public could prejudice the jury pool. Quashing them as hearsay is nonsensical. The Rules of Evidence don’t apply outside the courtroom.

He’s been charged with 3 misdemeanors. Is he attempting to plead not guilty in traffic court? Is that sort of thing even a jury trial?

I don’t think we have to go that far, yet. I think we just have to start out with the sheriff knowing who Ravnsborg is, but the question becomes why did he allow himself to be used? My understanding is that the victim was white, and I’m going to assume that the sheriff knew the victim, maybe not personally, maybe so. But allowing and participating in covering up a hit an run of a white male, probably Republican voter has me scratching my head.

Anyway, here’s wishing the defendant a fair trial.

True, but:

  • The damage is already done. I fully expect Ravnsborg to use the video release during appeal (presuming he gets convicted, which is not guaranteed).
  • This is after the prosecutor didn’t charge him with the SD equivalent of felony vehicular manslaughter.

I don’t have much faith in the criminal case. I think the only justice the Boever family is going to get is through its civil case, which I feel is helped by the releases from the criminal investigation.

I would like to know whether this could be a factor, since I have no idea what the sheriff’s beliefs are. It might be important. It also may very well be not.

Whole thing smells bad, from the trooper lending him a car on down.

I think we put the Sovereign Citizen Sheriff idea in a small pot, and keep it on the back burner for now. I do think the sheriff is hella exposed here.

Part that doesn’t add up, though, is that he loaned his car for the guy to drive a few dozen more miles.

Doesn’t add up if he knew the guy was drunk-- heck, he could get into a second accident and then the sheriff would have really big problems.

Something just is off about the whole dang thing.

Okay. Factor in my paranoia that my former sheriff was at the Bundy Ranch (in uniform), and my former AG (also former county prosecutor) was Curtis Hill.
I’m a bit soured on both offices after those two.
