While true, part of the point of having a separate executive is to allow rapid and effective response that a legislature can’t provide, particularly in times of crisis. In my view, the answer isn’t to hamstring the Governor’s/President’s response, but to make it far easier to remove the Governor/President should they abuse that power.

I also don’t see the value in forcing the legislature into a session that’s most likely outcome is just to extend or remove the time frame the governor can maintain the stay at home order. Its as pedantic as Rep Massie forcing a roll-call vote in the House to pass the CARES Act. I don’t give credit to anyone who forces people to unnecessarily risk their lives for a principle.

Eliminate Chicago and the collar counties from the state, and the rest of Illinois would become a third world Red State, like the others.

It’s precisely because of times of crisis that we need to be careful.

The President gets what, 60 days (I think, could be 90 but too lazy to look it up) to wage war in an emergency before seeking authorization from Congress to continue.

Saying that we can waive the laws just because we’re in an emergency would negate everything about emergency powers, because then we’d just be perpetually in a state of emergency, with unchecked executive powers.

The right answer is to bring back the legislature to take necessary action, that’s the check on unlimited executive powers, whether at the federal or state levels. And since you’d have to do that anyway in order to remove an executive, you’re bringing the folks back together regardless.

It’s all fucking grandstanding. In a health emergency, the Illinois Director of Health has even broader powers than the Governor, and she could impose them anytime to make up for anything the Governor can’t legally do under existing law.

IANAL, but I read their powers as being only active during the disaster declared by the Governor. Since that’s limited to 30 days, the powers of the Director of Public Health should be similarly time-constrained.

Oh, and how about updating the legislative rules to allow legislators to participate in sessions remotely? We’ve had the telephone since 1876 and practical applications of electricity since about 1882, and yet we still require everybody to travel hundreds or thousands of miles just to say “Aye”?

If only there was some way folks could have secure audio and video participation in meetings. Call me a dreamer, but someday, my friends. Some day… :thinking:

Politics. Both sides like to play that card. Nothing like having a member or two absent and getting to push through legislation that would otherwise lose, or block it when it would otherwise win.

Latest example was the big stimulus bill. Remember when it kept failing in the Senate and they had to give some ground to the Dems? That was only because a few Republican Senators were in self-isolation and couldn’t get to vote…

This article doesn’t mention it, but Judge McHaney’s decision was heavily influenced by Rep. Darren Bailey’s family members, each of whom filed a frantic friend-of-the-court brief, strongly urging McHaney to allow Bailey to leave their home—as soon as possible—for his own safety.

Not disagreeing, but the general media tone was that she DID have the power to keep this jackass under a stay at home order, even if the Governor didn’t because of the ruling. And yes, change the laws if faulty, just a shame that this jackass would force the issue, at this time, just for publicity.
