That wording in the 20th Amendment applies only when a President and Vice President have failed to qualify, so the âofficerâ requirement from Article II still applies in cases of death, removal, or resignation.
On the other hand, I think the âofficerâ argument is a bit weak. Article I Section 2 says:
The House of Representatives shall chuse their Speaker and other Officers; and shall have the sole Power of Impeachment.
So the Speaker of the House is an Officer.
One might argue that the Speaker is only an officer of the House, but thatâs a tougher argument to make.
Better poli-sci fantasy:

- The mirror trading scandal hits and 20-60 Rs are caught in its web and go to jail because under Biden, weâll actually have a FEC, FBI, and DOJ
- Trump gets to wear an outfit that matches his spray-on for what little is left of his mini-stroking life
- Bill Barr is investigated and convicted of obstruction of justice, gets cell next to Donnie so he can listen to him whine about how badly Bill messed up
I think itâs in part an artifact of English Common Law, which places a lot of political power on âprecedentâ rather than relying on statutory laws for everything. That has benefits in that it provides latitude to adjust to changing circumstances without necessarily rewriting conflicting laws in their entirety, but it also falls prey to bad actors who abuse the norms.
The alternative Statutory Law tradition requires every legal issue has to be written in a statute before it can be adjudicated, which leads to very byzantine law codes (more so than our Common Law) and itâs less quick to adjust when things change. It is more resilient to norm-busting, but as stated, also less maneuverable for changes in norms and expectations of the citizenry.

Under Scenario #1:
Every state delegation in the House would get one vote for the top three presidential candidates â presumably Joe Biden, Donald Trump and the third party candidate who accrued the most votes.
The House would vote for one of the top three by electoral votes. It would be just Biden and Trump unless some third party candidate wins a state, or D.C., or one of the districts of Maine or Nebraska. That seems unlikely this year. But faithless electors could also create such a scenario.
On the other hand, a third party candidate winning one or more electoral votes would make it more likely that neither Biden nor Trump gets a majority. If a candidate has a plurality but not a majority, it still goes to the House. (Which raises questions for a popular vote system if we manage to get rid of the Electoral College.)
Another fun fact: The House and Senate donât have to agree. In principle we could end up with Biden/Pence or Trump/Harris.
Actually, either spelling is acceptable, and itâs only been fairly recently that âforgoâ has become the favored spelling in American English.
The state of Louisiana operates solely by statute - the Napoleonic Code. IF you arenât aware, Louisiana is one of the most corrupt states in the country.
We arenât strictly Common Law - we are a mixture of Statute and Court precedent.
Itâs also worth noting just how necessary âDemocratic Mythsâ are.
And how unnecessary the Electoral College is.
Makes sense since they started as a French colony rather than most states which began as English colonies or American territories (or were taken from Spain/Mexico by the US much later on).
