Wondering same. I think upon reading this that they are continuing with the McGahn case instead and that the results of that would determine how they would proceed here?
In the filing, Democrats’ lawyers urged Kupperman to comply with whatever ruling comes of the Don McGahn case determining whether the former White House counsel has immunity from cooperating with congressional subpoenas, as Trump claimed at the time. McGahn was subpoenaed as part of the House’s followup probe of special counsel Robert Mueller’s Russia investigation.

I wouldn’t read too much into this beyond wanting to get on with the impeachment as quickly as possible. Trump’s ultimate defense is we shouldn’t do impeachment because the election is fast approaching and we have to spend all of our time on that. The law is crystal clear. Kupperman doesn’t have a real claim.
I am somewhat surprised that Democrats haven’t seemed to put any pressure on the courts for their slow scheduling posture, but I am not surprised the courts are slow acting here. No court wants to get between the congress and the executive. The judges are aware that this matter goes away in February or March 2020, one way or the other.

Also, if Alex Jones’ intent is to fuck with the trial, forcing a removal of a juror one day after jury selection lets the judge just say, well, let’s select another juror. If Alex Jones had done this 3 weeks into the trial, that messes with things much more.

I agree with you almost completely. Judge Leon could’ve scheduled an emergency hearing on this far sooner. One thing he did recently, however, was change the Dec. hearing from a preliminary to final hearing. Regardless, I think Schiff et al. determined they didn’t want the 'Thugs to drag this out claiming they are awaiting this hearing. They don’t need Kupperman.

Schiff only does this if he has a great hand, and so far the transcripts have been boffo. No need to take a flier with Judge Leon — it matters a lot who writes the decision on Executive Privilege that is reviewed by the High Court.

Unlike Nadler, Schiff is not allowing the intransigence to stymie the impeachment hearings and is simply noting the intransigence and moving on. The release of the witness transcripts is a good example. This week’s witnesses refused to appear, but we have the previous witness’ transcripts for the media to mull over and discuss. Adaptive management, I like it.
